Crown Worldwide Receives Safe Harbor Certification

The U.S. Department of Commerce, in consultation with the European Commission, developed a “safe harbor” certification, which demands that companies provide adequate privacy protection for all citizens.

This Certification makes it clear to all of Crown’s customers that their personal data (passport information, income, or other demographic information) will not be sold for profit or used to target audiences for marketing purposes. This also impacts where and how we share information internally and with sub-suppliers.

For example, this provision would make it illegal to share an assignee’s new address with a bank to solicit the employee for banking services in their new location -- even though banking is related to a transfer or assignment. Crown can only use the data for the purpose of the services we provide.

Safe Harbor will also help prevent Crown from experiencing any interruptions in their business dealings with the European Union or face prosecution by European authorities under European privacy laws.

Safe Harbor Benefits include:

  • All 25 Member States of the European Union will be bound by the European Commission’s finding of adequacy
  • Companies participating in the safe harbor will be deemed adequate and data flows to those companies will continue
  • Member State requirements for prior approval of data transfers either will be waived or approval will be automatically granted
  • Claims brought by European citizens against U.S. companies will be heard in the U.S. subject to limited exceptions
  • The safe harbor framework offers a simpler and cheaper means of complying with the adequacy requirements of the Directive, which should particularly benefit small and medium enterprises
